By accessing or using the Gift Discovery web application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Gathering Gifts Foundation Inc. ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Gift Discovery is a web-based tool that helps users identify their unique strengths and purpose through guided reflection and AI-assisted analysis. The Service includes:

  • A four-question discovery process
  • AI-generated Gift Statements, Key Words, and Noble Purpose statements
  • A companion chat interface for ongoing reflection (for registered users)
  • Access to educational resources about the Gift framework

The Service is currently provided free of charge. We reserve the right to introduce paid features in the future.

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be at least 13 years of age (or the age of majority in your jurisdiction)

3.2 Account Security

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Activities

  • Illegal Use: Use the Service for any illegal purpose or in violation of any local, state, national, or international laws or regulations
  • Harmful Content: Upload, post, or transmit content that:
    • Contains hate speech, threats, or direct attacks on individuals or groups
    • Is abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
    • Promotes violence, self-harm, or harm against any individual or group
    • Contains nudity or sexually explicit material
    • Is fraudulent, false, misleading, or deceptive
  • Impersonation: Impersonate any person or entity, misrepresent your affiliation, or create fake or impostor profiles
  • Unauthorized Access: Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
  • Interference: Interfere with, disrupt, or place unreasonable burden on the Service, servers, or networks
  • Automated Access: Use robots, spiders, scrapers, or other automated means to access the Service without our express written permission
  • Malicious Code: Upload, transmit, or distribute viruses, malware, or any other malicious code
  • Harassment: Harass, abuse, threaten, or harm other users
  • Privacy Violations: Collect, harvest, or use personal information about other users without their consent
  • Reverse Engineering: Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service
  • Competitive Use: Use the Service to develop competing products or services, or to train AI models that compete with our Service
  • Spam: Transmit spam, chain letters, or other unsolicited communications

Consequences of Violations

Violation of this Acceptable Use Policy may result in immediate termination or suspension of your account without notice. We reserve the right to investigate violations and cooperate with law enforcement authorities in prosecuting users who violate the law.

5. Intellectual Property

5.1 Your Content

You retain ownership of all content you create through the Service, including your responses to reflection questions, chat transcripts, and generated Gift Statements. By using the Service, you grant us a limited, non-exclusive license to:

  • Store and process your content to provide the Service
  • Use anonymized, aggregated data to improve the Service and AI models

We will never share your personal content publicly or use it for marketing without your explicit consent.

5.2 Our Content

The Service, including its design, features, text, graphics, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. The Gift framework and methodology are based on the work of [Nikki/Organization Name].

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

6. AI-Generated Content

The Service uses artificial intelligence (Anthropic's Claude language models) to generate Gift Statements, Key Words, and Noble Purpose statements based on your input.

YOU UNDERSTAND AND ACKNOWLEDGE THAT:

  • Accuracy: AI-generated content is based on statistical patterns and may contain errors, inaccuracies, or "hallucinations" (plausible-sounding but incorrect information)
  • Not Unique: Due to the nature of machine learning, similar inputs from different users may generate similar or identical outputs
  • No Guarantees: We make no representations or warranties about the accuracy, reliability, completeness, or suitability of any AI-generated content for your specific purpose
  • Your Responsibility: You are solely responsible for reviewing, evaluating, and verifying any AI-generated content before relying on or using it
  • No Ownership Guarantee: Due to the nature of AI, we cannot guarantee that copyright vests in any AI-generated output

Appropriate Use

AI-generated content from our Service is intended for personal reflection and self-discovery purposes only. You should not rely on AI-generated content as a sole source of truth or as a substitute for professional advice from qualified professionals (including therapists, counselors, career advisors, or other experts).

7. Disclaimers

7.1 Not Professional Advice

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of your data
  • Any errors or omissions in the Service or AI-generated content
  • Any other matter relating to the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS (CURRENTLY $0).

9. Indemnification

You agree to indemnify, defend, and hold harmless Gathering Gifts Foundation Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

15. California-Specific Provisions

Minors Under 18

If you are a California resident under 18 years old and have posted content on the Service, you have the right to request removal of such content. To request removal, please contact us at corequest@earthlink.net with the subject line "California Minor Content Removal Request."

Please note that removal does not ensure complete or comprehensive deletion of the content, as it may have been republished, shared, or reposted by other users or third parties. We will make reasonable efforts to remove the content from public view on our Service.
